Driving test conduct

In 2010 it is reported that 209 examiners were injured on test. At which point does protecting our property on test become an obligation? As instructors, would we allow ourselves to be put in a potentially dangerous situation, or an other person?
Although pupils are sometimes going to test unprepared, sometimes a good driver goes to test and turns into a panicking alien - surely the test should be terminated immediately? Should examiners be held responsible if they allow our vehicles to be damaged?

Yes I think examiners should have some sort of duty of care - to both the candidate and the instructors car.
But as with everything, where do you draw the line?

Sometimes it's other drivers that crash into test vehichles. Not the learners fault at all.
